Recently the City of Beech Grove introduced a proposal aimed at holding property owners accountable to maintain conduct and provide a pleasant environment for their neighbors. The proposal would define a disorderly house and a place of nuisance where prohibited conduct is suspected and where a notice will be sent ordering the owner to abate such suspected prohibited conduct. These orders to the property owner may include filing an eviction action

The Legislature went back to work last week and is scheduled to be in session until the end of April. This is a biennial budget year and we anticipate that education and ethics issues will be top issues. The Indiana Association of REALTORS® (IAR) will be proposing legislation to limit REALTOR® liability by providing additional protections in the use of seller disclosure forms. And with it being a budget year, IAR will be paying close attention to any tax issue that could impact real estate.

Client A, an army officer, was transferred to a new duty station and listed his home for sale with REALTOR® B as the exclusive agent. He moved to his new station with the understanding that REALTOR® B, as the listing broker, would obtain a buyer as soon as possible. After six weeks, during which no word had come from REALTOR® B, the client made a weekend visit back to his former community to inspect his property. He learned that REALTOR® B had advertised the house: “Vacant—Owner transferred,” and found an “open” sign on the house but no representative present.

Housing data released by MIBOR today shows a slight increase in closed sales in November with average and median sales prices rising more than four percent. November’s closed sales, while still positive, were not as strong as those in September and October. That two-month surge helped improve the three, six and 12-month analysis. Closed sales rose only 0.7 percent in November, but increased 8.1 percent for the three months ending in November. Indications of future activity were again encouraging with pending sales increasing 8.3 percent in November over November of 2013 and 11.1 percent for the three months ending in November.
