What Is Data Licensing?

MIBOR BLC® Listing Service database compilation is jointly copyrighted by MIBOR BLC® Listing Service and the listing brokers. This copyright is obtained to protect the intellectual property rights in the database content relating to listings on behalf of the listing broker. Therefore, any use of the MIBOR BLC® Listing Service data must be protected by a Data Licensing Agreement. The applicable use of the MIBOR BLC® Listing Service data governs what type of agreement is needed. There are three types of Data Licensing Agreements including IDX, VOW and Back-Office. IDX Information

The Internet Data Exchange (IDX) policy defines the MIBOR BLC® Listing Service Participant’s (the principal broker’s) authorization of limited electronic display and delivery of their listings by other Participants and their licensees s via the following authorized mediums under the Participant’s control: websites, mobile apps, and audio devices.

The Participant must have the ability to add, delete, modify and update information as required by this policy. All displays of the IDX electronic display or delivery of a listing must be under the actual and apparent control of the Participant and must be presented to the public as being the Participant’s display or delivery. Any IDX display or delivery by a licensee of the principal broker is subject to the Participant’s oversight, supervision, and accountability and must include the Participant's company name or logo in compliance with Indiana license law requirement. Only those data fields available on the Consumer Full Detail report may be included in the electronic display or delivery.

VOW Information

The Virtual Office Website (“VOW”) policy is a feature of a Participant’s website, through which the Participant is capable of providing real estate brokerage services to consumers with whom the Participant has first established a broker-consumer relationship (as defined by Indiana State law) where the consumer has the opportunity to search Broker Listing Cooperative® listing service listing information, subject to the Participant’s oversight, supervision, and accountability. A non-principal broker or sales licensee affiliated with a Participant may, with his or her Participant’s consent, operate a VOW. Any VOW of a non-principal broker or sales licensee is subject to the Participant’s oversight, supervision, and accountability.

Back Office Information

The licensing of MIBOR BLC® Listing Service data for use in Back-Office operations is specific to the Participant’s (the principal broker’s) internal use of the MIBOR BLC® Listing Service data within their brokerage for legitimate business purposes as governed by the Back Office Agreement.
